Air Toxics
Michigan’s air toxics program has not been revised since it was first adopted in the 1980s. To make the program more competitive and cost effective, MMA will work with the Michigan Department of Environmental Quality (DEQ) to implement recommendations made by the Office of Regulatory Reinvention (ORR) in the Department of Licensing and Regulatory Affairs (LARA) for agency and legislative changes in the state’s Air Toxics program. These changes include eliminating some rules and consolidating others to avoid duplicative regulations that exceed federal standards. Improving Michigan’s Air Toxics program will increase our competitiveness and make the program better for both the regulated community and the DEQ.

Update

The Air Quality Division (AQD) of MDEQ re-established the Air Quality Advisory Council to involve stakeholders in implementing the ORR recommendations. The advisory council is meeting monthly to discuss the air issues and implementation of the recommendations. A subcommittee has appointed to work on the air toxics recommendations. It met on January 17, 2013 to discuss various issues. MMA will post information on the next meeting of the subcommittee.

Background

In 2011 the Office of Regulatory Reinvention (ORR) conducted a thorough investigation and review of the rules, regulations and laws governing the activities of the Michigan Department of Environmental Quality (MDEQ). Following 5 months of meetings, the ORR sent 79 recommendations to Governor Snyder on rules and regulations that should be changed or eliminated in the MDEQ. Dan Wyant, MDEQ Director announced in early 2012 that the department would begin immediately to implement the Governor’s recommendations.
