Tax Seminar Helps Members Get Ready to File

Manufacturers gathered on 2/26/10 in MMA’s Headquarters building to gain new and valuable information for filing their Michigan Business Tax (MBT) in 2010. Three attorneys from Miller Canfield led the interactive 3-hour session, “’Tis the Season — Taxes That Is. Is Your Business Ready to File?” (Members can access a copy of the seminar presentation on the Seminar Resources page.)

The seminar began with a comprehensive look into the Kmart v Dept of Treasury case, in which Miller Canfield is actively involved in. At issue is whether Kmart Michigan Property Services LLC, a single member limited liability company disregarded for federal tax purposes, was permitted to file a return separate from its owner, Kmart Corporation. The case is ongoing and Miller Canfield is working with the Department of Treasury to support legislation to override Kmart decision before quarter ending 3/31/2010.

The seminar also went into great detail about the MBT and the MBT credits, including key points of controversy and ambiguity regarding the MBT including unitary returns, materials and supplies, and treatment of flow through entities and their partners/owners, recent RABs, FAQs and draft rules, and a discussion of some of the nuances and ambiguities regarding the many MBT credits for property taxes, new investments, wages and other activities.
